RIO DE JANEIRO – Gol Airlines has been ordered to pay damages to twin-sister athletes Beatriz e Branca Feres, bronze medal winners in synchronized swimming teams at the 2007 Pan American Games. The judge in the case found that the airline sold the pair tickets for a flight that did not exist, reports O Estado de São Paulo on Tuesday.
The judge of the 19th Civil Chamber of the Capital, Paulo Sergio dos Santos, denied the company's appeal and entered the judgment of $5,450 (about $3,285 US dollars) for each twin for moral damages.
According to the lawsuit, the athletes bought tickets round trip from Rio to Fortaleza, Brazil to compete in the Synchronized Swimming Championship in September 2009. They won the competition, but in trying to return to their home in Rio, were informed by an airline employee that they had bought the tickets for a flight that had already taken off, unlike what appeared on their “eTicket.”
The two had to pay the fare difference go get on the next flight. The new flight was delayed, “which meant that the twins would end up taking over ten hours to get home,” the Court found. A clear case of failing to provide service as contracted.
”The plaintiffs have suffered from discomfort, embarrassment and even extreme exhaustion, because they are athletes and they had just participated in an extremely stressful swimming competition. They have suffered emotionally and physically because of the hassles they endured," the Judge wrote.
