Biker Cited for Not Wearing Seatbelt

| CAMPO GRANDE, Brazil – A 20-year-old man has appealed a R$127 ($68 USD) citation he received for not wearing a seat belt while riding a motorcycle. The ticket, which was dated 30 November, was issued in the state capital, Campo Grande.

The offense of not using a seat belt while operating an automobile is serious—in addition to the fine, it would result in five points against his driving record. The man, who doesn't want to be identified, told G1 that he was passing the street corner referenced on the ticket at the time it stated as he was going home from work. “I've never seen such a thing as this,” he told G1.

Because he works during the day and can't take time off, he asked his mother to take care of his appeal against the offense. The woman told G1 that the appeal was successful and that the ticket was in the process of annulment on Monday. “Because of the amount, I would have just paid the fine—but there's no belt on a motorcycle,” she told G1.

Rudel Trinidade, the manager of Agetran, the agency which manages traffic citations in the city, said that he has 55 agents who apply 4 to 5 thousand fines per month. He said that this type of error is rare—but it does happen from time to time. “I have a whole team who do nothing but check for this type of inconsistency. Mistakes happen,” he told G1.

Trinidade also said the young man's fine was canceled right away. “If somebody receives a ticket with this type of error, just call Agitran and the problem will be solved—you don't even have to come in or go through the appeal process,” he said.

Last month in Fortaleza, Ceara, a man driving a Fiat Uno sedan was cited for driving an automobile without wearing a helmet. His citation was also canceled.
