| FORTALEZA, Brazil – Businessman Roberto Lima received a traffic ticket in the mail Tuesday citing him for not wearing a helmet while driving a Fiat Uno sedan. The ticket arrived on Tuesday afternoon and the date of the violation is September 22, at 7:45 am, reported G1 Ceara.

“They are assessing me a fine of $127 reals (about $70 USD) and I'll get points on my driving record,” the businessman told G1. Contacted by reporters, the Municipal Transit Authority of Fortaleza (AMC) admitted that the citation appeared to be a mistake and promised to investigate.

In the citation document, in the field “Type”, it indicates “driver not using seat belt” as the cause of the fine. But under the “Note”, it says “driver not using mandatory helmet,” which is an infraction of the Brazilian Traffic Code (CTB).
The businessman admits that his business owns the car in question and that he and an employee were driving at the location and time indicated on the ticket. He also remembers a policeman passing him that morning. He maintains that both he and the employee were both wearing seat belts and that they were not required to wear helmets.
Roberto says that he will fight the ticket if he has to—the court date is slated for January 16, 2012. He doesn't hold out much hope, however. He has fought tickets before and lost. “This isn't the first time I've received bogus tickets. The car has a tracking system and once I even printed out the records to prove that the vehicle was not where a ticket said it was. I lost anyway,” he told G1.
The AMC announced this morning that they were dismissing the ticket. They also confirmed that one does not need to wear a helmet while driving a Fiat automobile in Brazil.
